Chairperson Heiden called the Johnson County Board of Supervisors to order in the Johnson County Administration Building Boardroom at 9:01 a.m. as an electronic meeting due to concerns for the health and safety of Board members, staff, and the public presented by the novel coronavirus pandemic, COVID-19, in accordance with Section 21.8 of the Code of Iowa, as amended. Present: Lisa Green-Douglass, Pat Heiden, Royceann Porter, Janelle Rettig,* Rod Sullivan.*

FAIR HOUSING MONTH
APRIL 2021
Summary: The Fair Housing Act, Title VIII of the Civil Rights Act of 1968, as amended, enunciates a national policy of fair housing without regard to race, color, religion, sex, familial status, disability, and national origin, and encourages fair housing opportunities for all. The Iowa City Area Association of Realtors® and the National Association of Realtors® Code of Ethics is committed to the principles of the Fair Housing Act. Board Action: Proclaimed April 2021 as Fair Housing Month and urged all residents to recognize this celebration throughout the year. Motion by Green-Douglass, second by Porter, to approve Proclamation 04-15-21-01. Iowa City Area Association of Realtors® Chief Executive Officer Tyler Warner spoke.
Motion by Sullivan, second by Green-Douglass, to approve the claims on the April 15, 2021, Auditor’s Claim Register, as approved by a majority of the Supervisors.

Motion by Green-Douglass, second by Porter, to approve the minutes of the Formal Meeting of April 8, 2021.
Motion by Porter, second by Sullivan, to approve the payroll authorizations submitted by department heads and elected officials, as approved by a majority of the Supervisors.
Motion by Sullivan, second by Porter, to receive and place on file the Auditor’s Quarterly Report of Fees Collected for the quarter ending March 31, 2021, in the amount of $16,143.92, as submitted by County Auditor Travis Weipert.
Motion by Green-Douglass, second by Porter, to receive and place on file the Clerk’s Report of Fees Collected for the month of March, 2021, in the amount of $60,582.13, as submitted by Clerk of District Court Kim Montover.
Motion by Porter, second by Sullivan, to receive and place on file the Treasurer’s Semi-annual Settlement of the Board of Supervisors for the period beginning July 1, 2020 and ending December 31, 2020, as submitted by County Treasurer Tom Kriz.
Planning, Development, and Sustainability Director Josh Busard presented the staff report on Subdivision Application PZC-21-28017.
RESOLUTION NO. 04-15-21-01
RESOLUTION APPROVING THE FINAL PLAT AND SUBDIVIDER’S AGREEMENT OF HARPER HOLLOW JOHNSON COUNTY, IOWA
Summary: Application PZC-21-28017, the final plat of Harper Hollow, is submitted for approval. The Board of Supervisors approved the preliminary plat application, PZC-19-27809, for this project on June 11, 2020. Board Action: Approved and finalized the plat and Subdivider’s Agreement and named the documents to be recorded. Motion by Green-Douglass, second by Sullivan, to approve Resolution 04-15-21-01, effective April 15, 2021.
Convened Public Hearing at 9:21 a.m. on the Status of Funded Activities for the Clear Creek Watershed Improvement Project.
East Central Iowa Council of Governments Environmental Services Director Jennifer Fencl presented the following information regarding Contract #13-NDRH-007 for Com-munity Development Block Grant, National Disaster Resiliency (CDBG-NDR), for the Clear Creek Watershed.
A. General description of accomplishments to date, it is noted that the following has been completed: a watershed management plan has been completed; the following agricultural best management practices (BMPs) have been completed: 10 ponds and wetlands, 1 water and sediment control basis and 3 grade stabilization structures, the first construction bid packet has been completed and signed off.
B. Summary of expenditures to-date, through March 31, 2021, a total of $1,939,522 has been invoiced: $461,276 for construction; $551,523 for engineering and other technical services, such as land acquisition, appraisals, archeology, etc.; $256,515 for the project coordinator and related activities; $418,118 for flood modelling; $175,000 for the watershed management plan and related activities; $77,090 for grant administration. From a grant of $4,113,063, project costs are reimbursed at 100%; however, landowners are matching 10% of the construction costs for BMPs. These funds are used to support the project.
C. General description of remaining work, it is noted that the following is needed:
construct more BMPs, mainly ponds and/or wetlands, with the number to be determined by funds available and actual costs of practices bid in the future; complete the contracted, not-yet-built BMPs in the $247,378.76 contracted so far. An additional 37 practices will be bid in 2021 depending on Environmental Review and remaining funds available.
D. General description of changes made to the project budget, performance targets, activity schedules, project scope, location, objectives or beneficiaries, it is noted that no HUC-12 watersheds were added to the eligible area for BMP installation; the federal cost share amount was increased from 75% to 90 % to pro-mote landowner participation; and the project completion deadline was extended from 9/30/2021 to 12/31/2021.

RESOLUTION NO. 04-15-21-02
APPROVING CONTRACTS FOR THE PURPOSE OF ACQUIRING RIGHT-OF-WAY FOR GRADING AND PORTLAND CEMENT CONCRETE (PCC) PAVING PROJECT ON F44 (HERBERT HOOVER HIGHWAY) FROM 0.9 MILES EAST OF WAPSI AVE. TO 0.1 MILES WEST OF JOHNSON CEDAR ROAD KNOWN AS PROJECT STBG-SWAP-C052(120)–FG-52
Summary: Johnson County Secondary Roads Department needs to ac-quire certain Right-of-Way in order to complete Project STBG-SWAP-C052(120)–FG-52, grading and Portland Cement Concrete (PCC) paving of F44 (Herbert Hoover Highway) from 0.9 miles East of Wapsi Ave. to 0.1 miles west of John-son Cedar Road, which was previously approved for 2021 within the Five-Year Construction Plan. Board Action: Entered into contracts with the following parties to acquire certain Right-of-Way: Richard W. Miller and Jennifer D. Miller for $27,700.00, James W. Lloyd and Robin L. Lloyd for $11,050.00 (Parcel 12), James W. Lloyd and Robin L. Lloyd for $18,930.00, and Ellis R. Shultz and Cathleen T. Shultz for $1,720.00. Motion by Green-Douglass, second by Porter, to approve Resolution 04-15-21-02, effective April 15, 2021.
Motion by Green-Douglass, second by Porter, to approve Change Order No. 1 with Unified Contracting Services for a reduction of $8,802.95 for work on the Fuel Island Project.
Motion by Green-Douglass, second by Porter, to approve Change Order No. 2 with Unified Contracting Services for an addition of 38 calendar days to the completion date on the Fuel Island Project.
Motion by Sullivan amended by acclimation, second by Porter, to appoint Dave Curtis as Facilities Director effective April 28, 2021. Curtis spoke about his personal and professional backgrounds.
